Please read these Terms of Use carefully before using TrackRat.

1. Acceptance of Terms

By downloading, installing, or using TrackRat, you agree to be bound by these Terms. If you do not agree, do not use the app.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use TrackRat for personal, non-commercial purposes on devices you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

3. Restrictions

You may not:
- Copy, modify, or distribute the app
- Reverse engineer, decompile, or disassemble the app
- Rent, lease, lend, sell, or sublicense the app
- Use the app for any unlawful purpose
- Remove any proprietary notices from the app

4. Transit Information

TrackRat displays train schedules and real-time data from third-party transit agencies (NJ Transit, Amtrak, PATH, PATCO). This information is provided for convenience only. We do not guarantee the accuracy, completeness, or timeliness of transit data. Always verify departure times with official sources before travel.

5. Subscriptions

TrackRat Pro is available as an auto-renewable subscription. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Manage or cancel subscriptions in your device Settings under Apple ID > Subscriptions.

6. Intellectual Property

TrackRat and its content, features, and functionality are owned by TrackRat and are protected by copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRACKRAT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

9. Indemnification

You agree to indemnify and hold harmless TrackRat from any claims, damages, losses, liabilities, and expenses arising out of your use of the app or violation of these Terms.

10. Third-Party Services

The app may contain links to third-party websites or services. We are not responsible for the content or practices of any third-party sites or services.

11. Termination

We may terminate or suspend your access to the app at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the app after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.
